New Jersey Electronic Visit Verification Information
Nationwide EVV mandates were derived from the requirements of the 21st Century Cures Act. The Federal 21st Century Cures Act (2016) requires U.S states inclusive of New Jersey must implement an electronic visit verification (EVV) system for agencies delivering certain types of care. Electronic Visit Verification (EVV) software by definition is a system designed to electronically capture and verify provider visit information.
What is EVV?
EVV, or Electronic Visit Verification, is a web-based system that verifies when provider visits occur and electronically document the precise time services start and end. It ensures that people receive the care services they have been approved to receive. This technology is now required by federal law for specific services provided through NJ FamilyCare.
Electronic visit verification allows providers to confirm that services were actually delivered using a variety of electronic methods including a phone call, smart phone application, or a free EVV device in the home. The NJ Division of Medical Assistance and Health Services (DMAHS) is implementing an EVV system that meets state and federal requirements.
The state completed the vendor selection process and issued an official contract award to HHAeXchange, a statewide EVV provider. New Jersey intends to operationalize this EVV system by January 1, 2021 for Personal Care Assistance, MLTSS Home-Based Supportive Care, DDD Individual Supports, DDD In-Home Respite, and DDD Community-Based Supports.
Provider agencies are responsible for collaborating with DMAHS, HHAXeXchange, and Managed Care Organizations to ensure members are fully informed and educated as EVV is implemented.
NJ EVV REQUIREMENTS
What are the requirements for New Jersey agencies per the EVV mandate?
In concert with the 21st Century Cures Act, NC agency requirements for EVV visits note that any approved system must electronically capture:
- The name of the patient who receives a service
- The name of the caregiver who provides the service
- The exact type of care/services that were provided
- The exact location of the services provided
- The exact date of services provided
- The start and end time of the visit
WHAT IS THE START DATE FOR NEW JERSEY EVV?
EVV is Required beginning January 1, 2021
The NJ Division of Medical Assistance and Health Services (DMAHS) was set to implement an EVV system that met state and federal requirements in 2021. After completing a thorough vendor selection process, an official contract was awarded to HHAeXchange, a statewide EVV vendor. New Jersey implemented their EVV system January 1, 2021, for the following services:
- Personal Care Assistance
- MLTSS Home-Based Supportive Care
- DDD Individual Supports
- DDD In-Home Respite
- DDD Community-Based Supports
What services are required to use EVV?
The 21st Century Cures Act mandate requires EVV for all personal care services with an “in-home visit.” In the state of New Jersey this includes:
- Personal Care Assistance services administered by an agency
- Individual Supports, Community Based Supports, and In-home Respite care delivered through DDD programs
- Respite & Home-Based supportive cares delivered through MLTSS
Self-directed personal care services (the Personal Preferences Program & self-directed services coordinated through the NJ Division of Developmental Disabilities) will also require EVV
What Providers will the EVV Mandate Impact?
New Jersey’s mandate for electronic visit verification applies to all providers of Personal Care Assistance services, Individual Supports (DDD), Community Based Supports (DDD), In-home Respite (DDD & MLTSS), and home-based supportive care (MLTSS). All services which require an in-home visit are subject to New Jersey’s EVV mandate, including self-directed services (with the exception of live-in caregivers).
What is the data that must be collected through an EVV System?
- The type of services performed
- The complete legal name of the patient who received the service
- The exact date and time of the service
- The location or address where the service was performed
- The legal name of the caregiver who provided the service
- Exact start and end times services were performed
HHAeXchange is the state of New Jersey’s contracted EVV vendor, with the system set to aggregate incoming EVV data from providers and Managed Care Organizations.
Can I use an alternate EVV system outside of the state provided system?
The NJ Division of Medical Assistance and Health Services (DMAHS) allows agencies operating in the state of New Jersey to choose an EVV system of their preference if they so desire. This “alternate EVV system” must meet the requirements of the 21st Century Cures Act and additionally be able to securely transmit data to HHAeXchange. NJDHS requires that HHAeXchange holds the ability to interface with all existing electronic visit verification systems which meet the 21st Century Cures Act requirements. These efforts will be coordinated through HHAeXchange and/or the MCO.

If I use an alternate EVV vendor, how do I know it will work?
In concert with the requirements set forth in the 21st Century Cures Act, NJ agencies may use any compliant EVV solution that meets the following verification criteria and is able to aggregate with the state contracted HHAXeXchange EVV system :
- The EVV system must identify the individual administering the service during the visit
- The EVV system must identify the provider agency that employs or contracts with the individual providing the service.
- The EVV system must identify the patient receiving the service during the visit
- The EVV system must record the date of the visit
- The EVV system must independently verify the official start and end time of the visit
- The EVV system must record the location of the visit
